Collin County fireworks rules

Collin County is north of Dallas and Rockwall counties, and the county seat is McKinney. The Collin County Fire Marshal's Office is at 4690 Community Ave. in McKinney, phone (972) 548-5576.

The county fire marshal publishes clear guidance. In unincorporated Collin County, it is legal to discharge fireworks on your own private property, or on someone else's private property with the owner's permission. That does not override a city's authority to regulate fireworks within 5,000 feet of its limits, so if you are in a city's extraterritorial jurisdiction (ETJ), check with that city first. Possessing or discharging fireworks on U.S. Army Corps of Engineers property, like the land around Lavon Lake, is illegal. The county says violations can bring a fine of up to $500 per occurrence.

Most Collin County cities prohibit fireworks. McKinney Fire Department says it is illegal to possess or use fireworks in McKinney and 5,000 feet outside city limits, sparklers included. Frisco's police department says city ordinance makes it unlawful to sell, discharge or possess fireworks of any type. For Plano, Allen, Wylie, Prosper and other cities, check the city's code of ordinances or call its police non-emergency line.

For burn bans in unincorporated areas, use the fire marshal's Outdoor Burning page. The county has used the Keetch-Byram Drought Index to decide when to issue bans. Burn bans cover outdoor burning. A separate drought order under Local Government Code 352.051 is what restricts skyrockets with sticks and missiles with fins.

The statewide seasons apply in Collin County. Retail stands in unincorporated Collin County need a county Retail Fireworks Permit for each sales period. Any county-option season applies only if the Collin County Commissioners Court approves it by order. We have not confirmed a current order, so check the court's agendas or call the fire marshal.

If you are not sure whether your address is in a city, its ETJ or the unincorporated county, call the fire marshal's office before you buy.
